What Is an Enforcement Action?

An enforcement action is a formal regulatory response, an investigation, fine, or settlement, brought by a privacy authority like the CPPA or an EU data protection authority against an organization found to have violated a privacy law. Enforcement actions are the clearest real-world evidence of how a law gets interpreted and applied in practice.

Reading a privacy statute only tells you what’s technically prohibited; reading enforcement actions tells you what regulators are actually pursuing and how aggressively. The PlayOn settlement is a useful example: the underlying violation wasn’t a missing banner, it was a functioning CMP whose opt-out choice simply wasn’t being enforced by the tags on the site: a gap between what looked compliant and what was technically happening.
